Masters Conference Examines Legal Landscape in Wake of FRCP Changes
Washington, D.C. (October 25, 2007) - Wave Software is sponsoring the second Masters Conference for Legal Professionals at the Reagan Center in Washington, D.C. to discuss changes and fallout in the legal market from changes to the Federal Rules of Civil Procedure that were implemented on December 1, 2006. This conference will feature a distinguished array of E-Discovery experts and knowledgeable professionals from law firms, corporations, and the bench who will discuss strategies, practices and resources during this two-day conference to be held in Washington, D.C.
A survey released in May 2007 found that 83 percent of technology executives are not prepared for litigation under the new FRCP rules, with 67 percent indicating they were not even aware or familiar with their company's process of gathering ESI for lawsuits. A similar survey released in March 2007 indicated that 94 percent of those responsible for email policy did not feel their organization was prepared for the FRCP requirements.
The Masters Conference will provide a forum of discussion that addresses the new reality. Being 'litigation-ready' now requires due diligence on the part of attorneys and litigation support directors alike. Legal professionals must not only understand the rules, but also be able to comply with them and avoid sanctions.
One of the key elements of the new Federal Rules requires that companies in civil litigation meet and confer within 99 day of a lawsuit being files (and within 30 days of filing a Discovery Plan) to discuss how ESI will be handled and agree on issues such as what records will be shared, what electronic formats are acceptable, and what information/ESI is deemed 'reasonably accessible'.
